It's obviously not possible for the system to determine precisely what caused the patterns it detects, so there's no reason to assume guilty just because someone hits the Busted sign.

The automated system is there for two reasons:

1. To provide an immediate counter-measure in the event of abuse, it does this via the busted sign and the automatic penalities.
2. To warn us so that we can review recent behaviour to determine whether the situation was an accident, experiment, or deliberate abuse, and take appropriate action.

Obviously the account is still in play, so it's safe to assume it wasn't anything serious :) I believe this just lets him into the Entrecard Busted Club.
